In the conduct generally pursued by those concerned in these riotous meeting, called Charivari, we can trace many things which are highly culpable, and which render the persons concerned in them, subject to severe punishment.--Such as, assembling in a riotous manner in the streets and highways, armed, having their faces blackened, or otherwise disguised--by demanding money from the King's subjects by threats and menaces--and by damaging, or partly tearing down the house and habitation of individuals, in order to enforce their demands and obtain their ends. Now we find that by St. 1, Geo. 1, St. 2, Ch. 5. (commonly called the riot-act,) it is provided,--"that if any persons unlawfully, riotously, and tumultuously assembled together, to the disturbance of the public peace, shall unlawfully and with force, demolish or pull down, or begin to demolish or pull down, any dwelling house, barn, stable or other outhouse, such demolishing or pulling down, or beginning to demolish or pull down shall by adjudged felony without benefit of clergy, and the offenders therein, shall by adjudged felons, and shall suffer death without benefit of Clergy."--And by stat: 9, Geo. 1, Ch. 22. (commonly called the black act) we find it is amongst other things enacted--"that to appear in any high road, by night or by day, with the face blackened, or with other disguise, and being armed with offensive wepons, to the breach of the public peace, and the terror of His Majesty's subjects, is felony without benefit of Clergy." As to the demanding of money with threats and violence, it may be a question, how far it will constitute robbery in this case; the circumstances alone must determine. Robbery in its general acceptation, is described to be, the felonious taking of money, or goods of any value, from the person of another, or in his presence, against his will, by violence, or putting him in fear;--there is a variety of cases which come within this description, some of which apply strongly to that before us, in regard of what is considered to be a taking by violence, and, putting in fear--for it has been held, that where there is an immediate threat of injury to the property, as by pulling down a house with a mob, which produces great alarm, and induces a man to part with his money--it is a sufficient putting in fear, to constitute robbery, which is also a capital felony. As Cullen notes, Chisholme’s review of The Charivari in The Canadian Review and Literary Historical Journal (whose very title, as MacDonald observes, echoes that of the Society)102 aligns the poem with Dalhousie’s aims of researching and preserving "points of history immediately connected with the Canadas"103and, indeed, expands this statement of the Society’s purpose to include the "domestic habits and social pastimes"104 chronicled by Longmore.
